THE CHALLENGE SHALL BE CONSIDERED VOID WHERE, AND TO THE EXTENT, PROHIBITED BY LAW. THE CHALLENGE AND THESE RULES AND CONDITIONS SHALL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA AND ANY DISPUTE ARISING OUT OF THIS CHALLENGE SHALL BE BROUGHT IN, AND EACH ENTRANT HEREBY CONSENTS TO EXCLUSIVE JURISDICTION AND VENUE IN, THE FEDERAL DISTRICT COURTS SITTING IN ORANGE COUNTY, CALIFORNIA.

If any aspect of the Challenge or any rule or condition is found by a court of competent jurisdiction to be invalid, illegal or void, Entrants agree to allow the Sponsor to change such provision and, upon notice, to make it valid. Also, in such case, the remaining Challenge provisions shall remain in full force and effect and the Challenge shall proceed accordingly.

By entering this Challenge, each Entrant agrees to release and hold the Sponsor , CSUF and ASC harmless from and against any losses, damages, rights, claims and actions of any kind arising from (i) an exclusion or disqualification of an Entrant pursuant to these Rules; (ii) late, lost, misdirected, or unsuccessful efforts to notify Potential Winners of any prize; (iii) forfeiture of a prize and the selection of an alternate Potential Winner; (iv) late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible Entries; (v) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures or difficulties of any kind; (vi) failed, incomplete, garbled or delayed computer transmissions; (vii) any condition caused by events beyond the Sponsor’s control that may cause the Challenge to be disrupted or corrupted; and (viii) any injuries, losses or damages of any kind relating to a Challenge prize, or acceptance, possession or use of the prize, or from participation in this Challenge. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Challenge or announcement of the prizes.

The Sponsor reserves the right to cancel, terminate, modify or suspend this Challenge if it becomes technically corrupted or if for any reason the Internet portion of the Challenge is not capable of running as planned, including infections by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Challenge.

ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

 

By entering this Challenge, each Entrant will be deemed to have read, accepted, and agreed to be bound by these Rules.

By entering this Challenge, all Entrants agree that any and all disputes, claims, and causes of action arising out of or in connection with this Challenge, or any prizes awarded, shall be resolved individually without resort to any form of class action or other proceeding Challenge rules.
